Albuquerque's public water utility and the city of Rio Rancho will take over a private water company on Albuquerque's West Side.
The Albuquerque-Bernalillo County Water Authority and Rio Rancho argued that New Mexico Utilities Inc. was depleting the groundwater supply without pushing for conservation. They said it would be in the public's interest for them to take ownership of the supply, which provides water to 17,000 customers in a 34-square-mile area in northwest Bernalillo County.
State District Judge Geraldine Rivera ruled in favor of an eminent domain action against the company, said Nann Winter, an attorney with the water authority.
Tom Garrity, a spokesman for the company, said New Mexico Utilities hadn't received the court decision and could not comment.
