A federal judge says the trial of five defendants accused of bilking the state out of millions of dollars during the construction of the Bernalillo County Metropolitan Courthouse will have to be delayed.
The recusal by Senior U.S. District Judge John Edwards Conway meant the criminal case was reassigned to U.S. District Judge William "Chip" Johnson.
Johnson has scheduled a status conference next week with attorneys for the defendants, but he made it clear in a notice this week that the May 5 trial date won't be possible because of his existing trial docket and other commitments.
The indictment alleges a conspiracy by former state Sen. Manny Aragon and four others to siphon more than $4 million in kickbacks off the $83 million courthouse construction project.
