Albuquerque police say the man an officer shot after a chase in the Northeast Heights took a swing at the officer in the seconds before the shooting.
Tony Vigil, 52, remains in critical but stable condition at University of New Mexico Hospital suffering from a gunshot wound to his abdomen.
Police spokesman John Walsh said 13-year veteran Officer Jeffrey Stone, 37, fired one shot at Vigil around 8:30 p.m. Tuesday after chasing Vigil about half a mile from a speed enforcement zone at Burlison Drive and Academy Road Northeast.
Walsh said Vigil refused to stop, then drove slowly to a home in the 6400 block of Louise Place Northeast. There, Walsh said, Vigil jumped out of his car and ran toward a house with Stone close behind him.
Near the front door, Walsh said, Vigil turned toward Stone and swung at him with what appeared to be a shiny object in his hand.
"That is a deadly force situation," Walsh said.
Stone fired his handgun at Vigil once, striking him in the abdomen. Walsh said a knife was recovered at the scene, but it isn't clear if the knife was the object Vigil held.
Stone and the backup officer closest to him during the shooting, 10-year veteran Officer Chris Silva, 34, are on standard paid leave until the investigation into the incident concludes.
Vigil is expected to survive and face undetermined charges.
Walsh said Vigil has two outstanding warrants: one for charges including fleeing police and another for probation violation.
